Terms of Service

By accessing or using the Moxenjo platform operated by Moxenjo ("we," "our," or "us") at moxenjo.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.

Moxenjo is an AI-powered platform that enables business owners to create, configure, and deploy intelligent agents across multiple communication channels including WhatsApp, website chat widgets, and email. Our services include:

• AI agent creation and configuration based on natural language descriptions
• Deployment of agents to WhatsApp, website widgets, and other channels
• Google Calendar integration for automated appointment booking
• Gmail integration for sending appointment confirmations and reminders
• Conversation management and analytics dashboard
• Subscription-based access with tiered plans

To use Moxenjo, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these terms.

As a user of Moxenjo, you agree to:

• Use the platform only for lawful business purposes
• Not use AI agents to send spam, harass, or deceive individuals
• Comply with all applicable laws, including data protection regulations
• Ensure that your agents do not provide misleading medical, legal, or financial advice
• Obtain necessary consents from your customers before processing their data through your agents
• Not attempt to reverse engineer, exploit, or compromise the platform's security
• Not resell or redistribute the platform without written authorization

Moxenjo's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

When you connect your Google account, you authorize Moxenjo to access your Google Calendar and Gmail solely for the purpose of managing appointments booked through your AI agents. You may revoke this access at any time from your agent dashboard or your Google Account permissions settings.

Moxenjo operates on a subscription-based pricing model with multiple tiers. By subscribing to a paid plan:

• You agree to pay the applicable subscription fees as displayed on our pricing page
• Payments are processed securely through Razorpay
• Subscriptions renew automatically at the end of each billing period unless cancelled
• All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes
• Usage is measured in "actions" (agent interactions), and limits vary by plan

We offer refunds under the following conditions:

• Within 7 days of purchase: If you are unsatisfied with the service, you may request a full refund within 7 days of your initial subscription payment.
• Service unavailability: If the platform experiences significant downtime (more than 48 continuous hours) during your billing period, you may request a prorated refund for the affected period.
• Duplicate charges: Any accidental duplicate charges will be refunded in full upon verification.

To request a refund, contact us at support@moxenjo.com with your account details and reason for the request. Refunds are processed within 5-10 business days.

The Moxenjo platform, including its software, design, logos, and content, is the intellectual property of Moxenjo. You retain ownership of all content and data you provide to the platform, including business descriptions, FAQs, and conversation templates.

By using the platform, you grant us a limited, non-exclusive license to use your content solely for the purpose of providing the service to you.

AI agents created on our platform generate responses using artificial intelligence. While we strive for accuracy and relevance:

• We do not guarantee that AI-generated responses will be 100% accurate
• You are responsible for reviewing and configuring your agent's behavior
• We recommend monitoring agent conversations, especially during initial deployment
• You are ultimately responsible for the actions and responses of agents deployed under your account

To the maximum extent permitted by applicable law:

• Moxenjo shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the platform
• Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not liable for any loss of business, revenue, or profits arising from the use of AI agents on the platform
• We are not responsible for third-party service disruptions (WhatsApp, Google, Razorpay) that may affect platform functionality

We strive to maintain high availability of the platform but do not guarantee uninterrupted service. We may temporarily suspend the platform for maintenance, updates, or security purposes. We will make reasonable efforts to notify users in advance of planned downtime.

Either party may terminate this agreement at any time:

• By you: Cancel your subscription from your billing settings. Your access will continue until the end of the current billing period.
• By us: We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or fail to pay subscription fees. We will provide notice before termination except in cases of severe violations.

Upon termination, your agents will be deactivated and your data will be retained for 30 days, after which it will be permanently deleted.

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising from these terms or the use of the platform shall be subject to the exclusive jurisdiction of the courts in India.

We encourage users to contact us first to resolve any disputes amicably before pursuing legal action.

We may modify these Terms of Service at any time. Material changes will be communicated via email or through the platform. Continued use of the platform after changes are posted constitutes acceptance of the modified terms.
